#1 is acceptable, #2 is not. If you have evidence to support your claims, then state that evidence when posting.

Ok I think the user agreement should be worded more clearly. Many people have different views on what advertising actually means, and unless you specify what you mean by 'advertising' you may have a few problems with people thinking you are infringing on their right to free speech,especially regarding text. I would suggest ammending the user agreement to include something like this:
-Advertising is a public promotion of some product or service; the business of drawing public attention to goods and services
-Advertising is a form of communication that typically attempts to persuade potential customers to purchase or to consume more of a particular brand of product or service.
-Advertising is a communication whose purpose is to inform potential customers about products and services.
